An EmpCo catch-up plan — enforcement is live

Originally a month-by-month readiness plan to the 27 September 2026 application date — now a catch-up sequence, focused on the national transposition patchwork and the cross-functional compliance work that pan-EU brands need.

    Summary

Member States had to transpose by 27 March 2026; EmpCo has applied since 27 September 2026 — with no grandfather clause. The national patchwork is real, and pan-EU campaigns need country-specific overlays.

    The Member State patchwork

    • Germany approved the third UWG amendment in early 2026 with effects mirroring EmpCo.
    • France is transposing via a loi DDADUE, building on the Climate Law and the AGEC Law.
    • Italy has Legislative Decree 30/2026 in force from 24 March 2026, applicable 27 September 2026; AGCM confirmed as enforcer with fines from €5,000 up to €10 million.
    • Netherlands already enforces robustly under existing UCPD-transposing law via ACM.

    A step-by-step compliance sequence

    1. Act now — complete green claims inventory across owned, paid, earned and packaging surfaces. Triage Red/Amber/Green.
    2. Fix red claims — remediate every Red. Rewrite or remove generic adjectives, offset-based product-level neutrality, self-issued labels and whole-product claims based on a single component.
    3. Check amber claims — close substantiation gaps on Amber claims. Build evidence files with the Tier 1–3 hierarchy.
    4. Document now — publish consumer-readable summaries of transition plans (the EmpCo-compliant version of the ESRS E1 plan), with verifier reports linked.
    5. Embed compliance now — agency briefs updated, CMS vocabulary blacklists deployed, training delivered, incident-response protocol in place, recurring scan cadence live.
    6. Post-application — quarterly scans, named claims-owner sign-off on all new claims, periodic recertification.

A scanner is at its most valuable under live enforcement, when the volume of claims to triage exceeds what any human team can handle manually — and when missing one Red item can mean a regulator's letter today.
